Domain sale conditions

This is a sale agreement for a domain name between MobileSpecialists.net, Heinrich-Pierson-Str. 34,
34132 Kassel, Germany called as follows seller and the client. The sale object is a domain name where
the temporary limited ownership for the domain is sold. The right to control the domain will be released
to the client under the offer specific conditions as soon the full payment for the domain has arrived in
shortest possible time depending on technical conditions - up to 2 weeks.
The client can decide to hold the
domain managed with MobileSpecialists.net and use the prepaid time. The client can also decide
to manage the domain on his own and ask for the auth code any time. The auth-code delivery may take
some procedural time up to 2 weeks and will be delivered by e-mail to the client.
In case a domain is in ownership
of the seller from short time rules independent of the seller can aplly like the 60 days transfer lock required
by ICANN or similar regulations by the domain registries. In this case transfer-out or authcode-delivery is possible after the
waiting period and the seller will complete transfer/authcode-delivery within time of the waiting period + 2 weeks.
The domain is a single special service depending on third parties and excluded from the right of return. No
return after a buy is possible.
If prepaid time is used and the domain stays managed with MobileSpecialists.net the renewal for
a next year period must be prepaid at the seller bank account at least 10 weeks before the domain expiry.
Else the domain expires. The client can decide to hold the domain hosted with MobileSpecialists.net
until 12 weeks before expiry and then change to an other operator asking for the auth code.
Additional rules of the registrar and the registry of the domain apply all the time. The seller is not responsible
for any changes in prices, policy nor any other changes resulting form those third parties. The seller can
not be made responsible for any kind of loss resulting from changes or problems with the service
or this third parties. The client agrees not to charge the seller in any manner for this. The only
responsibility of the seller is to sell the domain. No other warranties apply to the seller.
For domain orders no 100% warranty can be given that a domain can be registrated for the client. If a particular
domain can not be registrated for the client a full refund for this domain will be sent back to the client
if payment was already done. In case of bank wire transfer the refund amount is only the same as the domain price.
Additional fees as bank fees can not be refunded. Additional fees for services will not be refunded - only
the price for the domain.
In case of bank wire payment the payment has to be sent within 48 hours of doing the buy / order. The payment
has to get on our bank account within 7 days from doing the buy / order. If payment has not come in to our
bank account within 7 days MobileSpecialists.net has the right to cancel the sale.
MobileSpecialists.net has the right to publish the sale price and country where buyers come from for domain
sales for statistical, informational and promotional purposes and for providing information to the domain
industry and community.
Jurisdiction place is Germany and court is german court.
